Acorn Rural Property Consultants is pleased to have secured a Certificate of Lawfulness for a dwelling in the Exmoor National Park. This certificate confirms that the dwelling is free from an agricultural occupancy condition attached to a planning permission granted in 1980 for a dwelling at the property.
The application involved detailed analysis of the property’s planning history. We demonstrated that the dwelling was built outside the red-line boundary of the approved planning application, meaning that the planning conditions, including the agricultural occupancy restriction, did not apply. After careful consideration of the evidence, including over 40 years of continuous occupation, the planning authority confirmed that the dwelling was lawful and free from encumbrance of the planning conditions attached to the planning permission.
The certificate ensures that the dwelling can be occupied without the previous restrictions, providing the property with greater flexibility for future use.
