Certificate of lawfulness issued for unrestricted dwelling in Cornwall

Acorn Rural Property Consultants has obtained a Certificate of Lawfulness for a dwelling in Cornwall, confirming that the property is free from an agricultural occupancy condition (AOC) attached to a planning permission granted in 1991 for a dwelling at the site.

The case involved demonstrating that the dwelling was constructed in a materially different position from what was originally approved, with part of the building located outside the red-line boundary of the planning permission. As a result, the planning conditions, including the AOC, were not enforceable. After reviewing the evidence, the local authority confirmed that the dwelling, having been in continuous residential use for over 30 years, is lawful and free from the original restrictions.

This certificate allows the property to be occupied without the limitations imposed by the AOC.
